When Dennis More wanted to build his own harbour, he simply started digging.

Using earth-moving equipment, he dug a canal through wetland on his 45-hectare property at Leopold, near Geelong. He smashed through the mouth of Corio Bay, built two rock groynes on the seabed and channelled water into a holding pen he apparently intended to use as a marina. But Mr More did not have a permit for the work, which experts fear could damage the bay.

Though Mr More is believed to have been building his harbour for more than a year, the City of Greater Geelong was shocked to learn of it last month.

"It's incredible to think someone would do that," Cr Rod Macdonald said. "I live in the area and I wasn't aware of it. The lay of the land means it's hard to see what is going on."

The council has taken Mr More to the Victorian Civil and Administrative Tribunal demanding that he rehabilitate the site, which covers about 10 hectares. Mayor Shane Dowling said: "Council is concerned at the potential environmental damage caused by the excavations, including the significant loss of native vegetation."

Mr More, a developer, would not comment.

But last month he told the Geelong Advertiser he should have investigated the need for a permit. "I think I was probably in Disneyland at the time," he said. Mr More also reportedly said developers had shown interest in creating berths for the harbour. "It looks great . . . but at the end of the day it's all subject to whether I had to get a permit," he told the Advertiser.

Doug Miller, manager of coasts for the Department of Sustainability and Environment, said it was one of the most bizarre cases he had come across. "It is unusual that someone would not understand or be aware that permits were required," he said.

Mr Miller said the department was seeking immediate remediation work to prevent sediment from the construction washing into the bay. It also was seeking advice on whether the digging had unearthed acid sulphate soils that could harm marine life.

Though Mr More owned the land up to the high water mark, he had built the groynes on the seabed, which was Crown land and required a permit, Mr Miller said. "It is extremely unlikely approval would have been granted for the groynes on Crown land."

Mr Miller said the department had met Mr More's consultants and demanded removal of the groynes. Saltbush vegetation, which stabilised the shoreline, had been damaged during the excavation work and needed to be replaced, he said.

"Mr More has made a very big mistake, but the focus of of our attention at the moment is to achieve immediate remediation of damage done to Crown land."

Wayne Langmaid, owner of nearby Sands caravan park, said a mussel farm had once been on the property and he had assumed Mr More was simply redeveloping the aquaculture site. "The work was going on from 6.30 in the morning to six at night all over summer," Mr Langmaid said. "Everyone's pretty entertained by it. The bay needs more facilities for boating, I think Geelong doesn't capitalise on tourism assets enough."

Ray Tremul, a resident of nearby Viewbay Drive, said he once asked Mr More what he was excavating. "He said he wasn't sure what he was doing," Mr Tremul said. "It's funny he could go so long without the council taking notice."

Joan Lindros from the Geelong Environment Council said she believed Mr More should be fined. "It's just absolutely outrageous. He will have caused sedimentation in the bay and will have a very polluted wetland," Ms Lindros said. "He must have known he needed a permit, he's a developer."

Last weeks Geelong Advertiser asked the guy why he didn't get a permit and he replied something like "I must have had my brain turned off that day".
Its going to take him a hell of a long time to fill it in.

i cannot really believe the council didnt know about it, it was in the paper easily a month ago, saying how good the marina would be for the area, i remember reading it and thinking how much of a good idea it would be - the current ramp / halfarsed marina in geelong is a joke...

He would probably do more damage to the environment by filling it in - my guess is that it stays, he cops a ****y litle fine, subdivides the land and makes millions...

I think he might be expecting this...
