Default loss of points, going to full license?

so, some *** cop booked me today, 88 in a 50 zone, about 10 meters inside the 50 coming from a 100 zone. $621 and 4 points. anyway, i am on my green p's, have either 4 or 5 points remaining, and will be eligible to get my full license before i need to pay my fine. is it possible to get my blacks before i loose my points to avoid loosing my license? This is in NSW by the way

Not too sure about that one.

But because you are a P-Plater and got done for more then 30k's over but less the 45, I'm pretty sure you will be slugged with a 3 month suspension.

hmm he didn't say anything about that, just the fine and 4 points. sure hope not. whats really annoying, is that he let the loaded semi trailer in front of me go and booked me, whats more dangerous a semi doing 40 over or a ba ute slowing to the limit?

If you're in NSW you will be suspended if you get 12 points in 3 years on an unrestricted licence.. P's its worse I thought

Just checked RTA's website...P2 drivers cant exceed 6 demerit points

Points are allocated as soon as you pay the fine...However the number of points to be added should already be on your infringement notice which , because the offence happened while on your P2's, the fact you get a full licence before you pay the fine may be irrelevant

I believe that if you pay the fine after you get full a license then you loose points off your full license, therefore you should be OK. You really need to check this with someone in the know.

Not sure about NSW, but a similar happened to a mate, he had 3 points left, lost 4 points, didn't pay the fine, it went to SPERS, he then went onto is opens, and paid the fine.

AFAIK you have not "accepted" the fine until you have paid it, i.e. the points dont come off straight away because theres the option of court etc (or nominating another driver if camera detected offence)

Feel free to correct me if i am wrong

Depends how many points he has already...If he has 8 already then this 4 will take him to 12 , so a 3 month loss of license unless he does the good behaviour period of 12 months without incurring more than 1 point.

That is with a normal license ....so what is uncertain is how being a P2 changes that

I would be checking the statute on the distance from the sign that you have to comply within? Think you may find that you have 100meters from the posted position to comply/ reduce to that speed! Ive been wrong before, but rarely.

Otherwise, just drag out payment, nominate to go to court, defer it, and one your on your blacks just pay it, you should be fine then.

Yeah , he was 30+ over the limit but I think it's rather harsh that he was just 10m inside a 100 zone doing 80 odd...not as if he wasn't slowing down....Worse place to get done is coming into a country town from a 100 zone....A good revenue raiser for the local sheriff.

I think there's a huge difference doing 30+ coming into a country town and 30+ driving down George St in Sydney CBD in terms of road safety...obviously the later being quite dangerous.

Sorry buddy, I think you should just cop it. Speeding is speeding and if you've been done for 38km/h over '10m' into a 50 zone, you may very well have been done for 15km/h over 100m into the 50 zone a little later down the road.

It's really difficult to justify speeding, as people don't speed during their driving test, so how can they not understand when they get their license that there is no tolerance for it.

In 10, 5 or even 1 years time you will have forgotten about this and will have got over it. So don't dread it too much chief.

I'd write that off as catering to the masses or just proof that some RTA employees and some cops are a little stupid themselves.
I know its only a little thing but it just bugs me that something so simple can't be understood by so many people.

I keep telling my mates that people are generally pretty stupid but I keep waiting to be proved wrong. I think I must be the stupid one for waiting

Please don't hold me to this following comment, but I do believe it is "true" in relation to "points on your licence" debate. You were speeding, bad luck, you pay the price. However, this IS the trick.
Lets say you were caught alledgedly speeding and recieved a $410 dollar fine, accompanied with 4 points added to your licence. You simply write out ( or pay) a cheque at a greater value of the fine itself ( lets say $413 in this example.)
The system within the department responsible for the fine will then have to "send you out a cheque for the difference of $3" and you simply don't bank it, just tear it up and throw it in the bin which simply leaves your fine account open. Keep in mind your points are NOT added until the account is closed. Your points are not accessed until the transaction is complete. And the system will be happy because it has got it's money, so it will leave you alone!
Now of course none of this is illegal, and of course it does not promote breaking the law, so it should be fine by the mods to have this posted here. I obtained this information from a reliable source, but please don't ask me for information that may be deemed illegal.

There is no way in Hell any copper would let a semi-trailer go at 40 k/ph over the limit.

Learn some punctuation, whinge to someone who cares and learn to control the speed of your car.

It must have had an 70 or 80 zone in between.

Get over it mate you were speeding bad luck. A lot of people on here have been caught speeding aswell (me included) and some have lost their license (me included) but no need to make a thread if you are clearly in the wrong. Cop it on the chin and move on.

Old old ancient trick used for many years. I have used it many times in the past quite successfully.
Unfortunatley the systems have been changed and the loop hole closed so it doesnt work anymore.
Sister in law work for Infrigment Processing Bureau so Im pretty up with what the laws are now.

thanks for all those who helped out, and to everyone telling me to cop it, you tell me you've never coasted down from 100 to the speed limit coming into a country town and sped a little, still on highway before you got to any houses etc? well, i was behind the truck the whole time, how could he be going any slower than me?

There's a big difference between coasting just over the limit and doing 40 over....
Judging by your 'assesment" of this maybe you failed the attitude test with said officer too....

And FC i have never seen that dramatic of a speed drop either, not even roadworks.
I was told the speed zone cannot drop by more than 30K's directly on either side of the sign

There are a few out this way that go from 100 to 50 or 60, and a couple the go from 110 to 60. Not every town had the 100, 80, 50 set of signs.

it is fairly simple. if the sign says 50, then you need to be doing 50 at that point, not some indeterminate point afterwards. cop it sweet.

Agreed, the sign doesn't say: be doing 50 whenever you've coasted down to that speed, or whenever convenient to you.
And yes many of us have sped, that doesn't make it right. You got caught for it, pay the fine and learn a lesson.
Isn't there enough of these "i got caught speeding but i don't want to deal with the consequences..." threads?

I can't believe the arrogance in this thread or if not arrogance the number of "do gooder saints" trotting out their "tut , tut naughty boy" criticisms of the OP.

The OP was simply asking a question about demerit points and how the offence is likely to impact on the number of points he will accrue given the transition from P2 to an unrestricted license.

I can't see anywhere where he said he didn't want to "deal with the consequences" as you put it.

All points now come off your license immediatly. They closed the loophole about paying the fine quite some time ago. As soon as you get booked you now lose the points, regardless of when you pay your fine. So effectively, Your screwed mate

If your in a 100 zone and see the 50ahead sign, surely that's when you should start slowing down to 88. And if there is no 50ahead zone, surely you should be slowing down to 88 before the 50 sign, not after.
