Angry vehicle rego transfer

this is not a question that i thought i would ever have to ask

what is the law that when ya buy a car ?

i found out yesterday that the el i bought hasnt been tranfered into my name yet

where do i stand on this

no i bought the car from an un named car yard in north geelong

they told me yesterday that they still have papers for my car

hence the rego hasnt been tranfered

I went through something similar with my Eunos, I went back to the dealership to kick some butt and they said there had been some stuff-up with Vicroads. It was sorted in the end.

Are you saying they are refusing to do the transfer?

most car yards transfer the regos once a month, i had the same thing happen to me, the cops pulled me over once, and the vehicle was still in the yards name. how long have u had the car??

yes they are saying the wont do the transfer as they were doing a favour for the fiance people i got the loan through and they owned the car before me now they (the yard) are waiting for payment on warranty work done

It might be different in VIC but dont you have to go to the RTA and transfer it into your name?

I'd have a word to a lawyer, Jason. Often the outcome of nasty situations like this is dependent on contracts and other paperwork.

Isnt it the new owners responsiblillity to transfer the car now that he is the owner.

I assume you have the rego papers. If you go to the RTA and tell them you bought the car and wish to transfer it into you name they should be able to do it for you (if its the same as NSW) also in NSW you have a certain amount of time to di it and if its not done in that time you get fined.

well i have all the paper work with all the details and stuff and a copy of the road worthy now as far as i can see the road worthy is out of date and the car still in their name

I thought with car yard sales (with an LMTC) they had to do all that, and there is also the tranfer of stamp duty fee, which is $8 for every $200 the purchase price was plus another $22 or so admin fee

Sounds a bit dodgy, especially rhe bit where they say they are doing the favour for the finance company

yeh the finance company owned the car

i had to buy a car from a car dealer to get the finance the car yard did a favour for the finance co and this is where it gets me

I'd say take all the paper work down to the RTA and see what they can do.
If they cant change it over for you they might be able to point you in the right direction as to who you should talk to about it.

a car yard here are supposed to send the tranfer papers in 48 hrs of the car being picked up

Ok this is just my experience with car yards but again it all may be different in VIC. the car yard or person selling the car has to send through a notice of disposal to say they are no longer in possession of the car and you have to go the RTA and show them the papers and say "I now own this car please put it in my name." The notice of disposal doesn't even have to be sent as long as you have the rego papers signed over to you in your possession then you can get it changed into your name. and you have X amount of days to do it. nope, thats not how it happens in vic..... its entirely the car yards responsibility...

u got me wurryed now i bought my ed from a dealler and thay asked who's name i want the car under coz thay had to get it regoed and rwc witch i presume thay did

lol well that explains everything...... buying a car as is means it doesnt come with a RWC..... so it cant be registered / transfered if it has no RWC........ so you have to do this yourself..


very different when you're buying a car thats worth something... that comes with reg and RWC. you'll probably find that if you bought a car where you are that has rwg and a roady it will be all done for you.......well it should be

i would rather not buy a car in this way as it means you havent got a leg to stand on if something goes wrong with the car.........they are not obliged to offer you any kind of repairs if you buy it as is....

Im have trouble understanding this

So basically your saying, You brought a car from a car yard, thought it was all sweet, found out it hadnt been put in your name, asked questions and the car yard/dealer said they were doing the finance company a favor selling it? and the finance company had the car in there name...


A. If you brought it from a dealer, it should of been in there name
B. The dealer has to do all paperwork
C. If the car had finance still owing on it, it couldnt of been in the dealers name and thus making illegal for the dealer to sell it under his LMCT and you sign any paperwork or anything to do with stat warrentys, cool off period ect
D. How much do you earn ect ect, you may be eligable for legal aid, if not ask your parents...

I have only fallen into that trap once ($12000 4wd needed engine rebuild after 2 months) and it cost me allot of money I had been very lucky up until then I will never do it again on an expensive car. The EB I bought AS IS for $1300 cash, Ticket price was $2500
