Default speeding fine in brisbane

Received a speeding fine today. 73kph in 60 zone.
I am considering challenging the fine as there are two cars in the photo and I am not certain if I did speed.
I am heading away from the camera and the other car heading toward the camera. The other car is also on the side of (closest to) the camera.

I would like to know if any one here challenge the speeding fine before?
If so, how much court cost do you have to pay if youloose. :

The camera does not register speed of vehicles coming towards it, so it is not relevant that there is a car coming towards the camera.

The camera will take a photo of vehicles traveling away from the camera once they have been detected to be speeding, cameras will also give you a fair bit of leeway, so if you got the fine it means you were speeding.

Not sure how you would be able to challenge it, you have a photo of your car speeding, and you are not sure if you were or not..so what are you going to do, go to court and say to the magistrate, "sorry, but I am not sure if I was speeding, but can I be let off?"

Thanks FPV GT40,
i am just not aware that the camera does not register the speed of the car coming toward it.
I thought the camera takes the speed of what ever passing it.
I am question this because the photo is taken from the other side of the road thus my car is furthest away from the camera and the other car is thus closest to the camera.
i just don't want to pay other peoples fines.

Bieng your the furthest car away sounds dodgy . Maybe even showing the photo to your local cop shop will get you the answer you will probly need .

In Queensland mobile cameras can work both ways or only one, it depends on how they are set up.

Was it a mobile one or one of the new fixed ones you have down there?

Did hear something on news about the Burpengary? (the north side one on the main highway) booking people in the close lane for people speeding in the other direction on the other side of the dual carriageway.

I have seen many pictures with 2 cars in them, so I doubt that gets you off straight away anyhow
I have also been flashed when I was not speeding (I had seen the camera there before) but the person in the other lane was and have not got a ticket "by mistake" yet.

If you are 100% sure, maybe you can fight it, not sure on costs but they would probably exceed the $250 fine.

It likely to be a mobile one as I am not ware of a fixed camera along Newham rd, mt gravatt east.
The fine is $150 with 3 demerit points.
If court cost if additonal $150 or less I will fight it.

Are you able to scan the pic with all identifying features removed? Sounds a little bit odd to me if it was a roadside camera. In the pic there’s usually a very small area that they refer to as an enforcement zone. If you genuinely believe that you were not speeding, it may be worthwhile getting some professional advice.

There was an uproar down here a while ago when a few mobile speed cameras were set up detecting the wrong speed. This was only uncovered because people took the matter further. It is one of the reasons why the contract with Tenix Solutions was hanging by a thread. I’m not sure if it is going to be renewed.

I’m not suggesting that this is the case here, however, you never know. There could be an issue with how the camera was set up.

Is there even a remote chance that you were speeding and you genuinely don’t remember doing it?

After seeing that picture, I’d certainly be seeking some professional advice. This does not look right to me. How did they determine that you triggered the camera? Usually on a data block, it will say if you were approaching or exiting the camera site.

Looks like to me (as I have had a fine for this as well), the car in the center of the pic is speeding. It's the tell tale sign of how the camera works, nice full view of the car, licence and blah blah.

Your car is off center. Also to the far left. Pretty hard to say a car mostly out of shot is the cause of it, with a car in perfect full view.
I mean, isn't that the idea of a speed camera to get the "Money Shot"??

I thought you couldn't be fined if 2 cars in shot?

Could argue as well, that if you were speeding going away from the camera, where would the car have to be, to be classified as a normal speeding car in full view.?

if it was me i wouldn't be paying a cent until i'd had it checked out. i've heard of fines getting sent to both parties too. quite a lot of people just pay up without questioning it and hey presto. double revenue.

mmm, never seen one like this before, when I posted my previous comment I thought that your car would have been closest to the camera, and the oncomming car would have been furthest.

This looks a bit strange, I am no expert on this, but would get it checked out, may be take it to the local police, in the area where the speed camera is hopefully and request an explanation.

In Brisbane I have been done going both toward and away from the mobile camera. A mate I know has contested one of these and lost and they usually double your fine in the court. The decision is yours.

Wouldnt it be great if you could contact the other driver, im sure they were also sent a fine. I would definately contest it and make them proove it was you. Image if the media got hold of this and both cars were fined!!!

Thanks all you guys for the info. i now know what the small "A" in the top left corner of the frame means. Look like I best seek legal advise to see if its worth challenging. If not, I just pay up and be more careful next time.
